By downloading, installing, or using Macros AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. Macros AI is a product of Afrivance AI ("we," "our," or "us").

These Terms constitute a legally binding agreement between you and Afrivance AI. Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Special Notice: If you use the diabetes management features, you acknowledge additional terms and disclaimers in Section 5 below.

2. Description of Service

Macros AI is a comprehensive nutrition tracking application that helps users monitor their daily caloric and macronutrient intake. The App uses artificial intelligence to analyze food images, provide nutritional estimates, and offer personalized guidance.

Key Features Include:

• AI-Powered Food Recognition: Analyze photos of meals to identify food items and estimate nutrition
• Nutritional Tracking: Monitor calories, protein, carbohydrates, and fats
• Personalized Goals: Set and track custom nutrition goals based on your profile
• Meal History: View and manage your meal logging history
• Progress Monitoring: Track your nutritional intake and weight progress over time
• AI Nutrition Coach: Interactive AI-powered chatbot providing personalized nutrition guidance and meal planning
• Meal Plan Generation: AI-generated daily and weekly meal plans based on your location, dietary preferences, and goals
• Diabetes Management Tools: Specialized features for tracking blood glucose targets, insulin ratios, glycemic index, and carb counting (optional)
• Location-Based Recommendations: Culturally appropriate meal suggestions using authentic local foods from your region

The App is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

3. User Accounts

Account Types

You may use the App in one of two ways:

• Guest User: Limited functionality with data stored locally on your device
• Registered User: Full functionality with cloud synchronization via Google authentication

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring the accuracy of information you provide, especially health-related data
• Complying with all applicable laws while using the App
• Understanding that YOU are responsible for all health decisions, not the App

Account Security

You agree to use a secure password and to keep your login credentials confidential. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Accuracy Disclaimer

Limitations of Accuracy

Please be aware that:

• AI Estimates: Nutritional values are generated by artificial intelligence and are estimates, not exact measurements
• Variability: Actual nutritional content can vary significantly based on ingredients, preparation methods, portion sizes, cooking techniques, and food brands
• Image Quality: The accuracy of food recognition depends on image quality, lighting, angle, and food visibility
• Database Limitations: Our AI may not recognize all foods, especially regional or ethnic dishes, or may misidentify similar-looking foods
• User Verification: You should always verify and adjust nutritional information as needed
• Portion Estimation: AI-estimated portion sizes are approximate and may differ from actual amounts

5. Medical Disclaimer & Diabetes Management

General Medical Disclaimer

Always consult with qualified healthcare professionals, registered dietitians, or nutritionists for:

• Medical advice and dietary recommendations
• Treatment of medical conditions including diabetes, heart disease, kidney disease, or any chronic illness
• Weight management programs
• Specific dietary restrictions or requirements
• Any health-related decisions
• Medication management and dosing decisions

Never disregard professional medical advice or delay seeking it because of information provided by the App.

Diabetes Management Features - Specific Terms

Diabetes Features Limitations

You acknowledge and agree that:

• Individual Variation: Blood glucose responses to food vary significantly between individuals and even within the same person at different times
• Multiple Factors: Glucose levels are affected by stress, illness, exercise, medications, hormones, and many other factors not tracked by the App
• No Medical Supervision: The App does not provide medical supervision or real-time monitoring
• Emergency Situations: The App is not designed for emergency medical situations
• Glycemic Index Estimates: GI ratings are approximate and may not reflect your personal glucose response
• Carb Counting: Carb estimates are based on visual analysis and may differ from actual values
• No Medical Validation: Recommendations are not validated by medical professionals

Your Responsibilities for Diabetes Management

If you use the diabetes features, you agree to:

• Work with qualified healthcare professionals to establish your insulin ratios, target glucose ranges, and treatment plan
• Obtain all insulin ratios and sensitivity factors from your healthcare provider, not from the App
• Monitor your blood glucose regularly as directed by your healthcare team
• Keep regular appointments with your healthcare providers
• Inform your healthcare team that you are using this App
• Report any unusual patterns or concerns to your healthcare provider immediately
• Maintain an HbA1c monitoring schedule as recommended by your doctor
• Have a plan for managing hypoglycemia and hyperglycemia

Limitation of Liability for Diabetes Features

WE ARE NOT RESPONSIBLE FOR ANY HEALTH OUTCOMES, INJURIES, OR DAMAGES RESULTING FROM:

• Reliance on App-generated insulin dose calculations
• Reliance on glycemic index ratings or glucose predictions
• Changes to medication based on App recommendations
• Hypoglycemia, hyperglycemia, or diabetic ketoacidosis
• Any health complications related to diabetes management
• Errors or inaccuracies in carb counting or nutritional data
• Delayed or inadequate medical care due to App usage

6. AI Nutrition Coach Terms

AI Coach Description

The AI Nutrition Coach feature uses Google Gemini AI to provide:

• Conversational nutrition guidance and meal suggestions
• Personalized meal plan generation (daily or weekly)
• Location-based recommendations using local and culturally appropriate foods
• Analysis of your meal history and progress
• For diabetic users: Specialized guidance including GI ratings, insulin calculations, and glucose predictions

AI Coach Limitations

You acknowledge that:

• Not Medical Advice: AI Coach responses are for informational purposes only and do not constitute medical advice
• AI Limitations: The AI may provide incorrect, incomplete, or outdated information
• No Professional Relationship: Using the AI Coach does not establish a professional healthcare relationship
• Context Limitations: The AI cannot fully understand your complete medical history, current health status, or personal circumstances
• Cultural Appropriateness: While we strive for cultural accuracy, suggestions may not perfectly align with local customs
• Meal Plan Variability: Generated meal plans are suggestions; actual preparation may differ in nutritional content

Location-Based Features

The AI Coach uses your location (country and timezone) to:

• Suggest meals with authentic local ingredients
• Respect cultural meal timing customs
• Use appropriate local food names and terminology

Your Responsibilities

When using the AI Coach, you agree to:

• Use AI-generated advice as suggestions, not absolute directives
• Verify information with qualified professionals before making significant dietary changes
• Not rely solely on AI advice for medical or health decisions
• Understand that AI responses are based on your input and may be incomplete
• Review and adjust AI-generated meal plans to fit your actual needs and preferences

7. User Content

Ownership

You retain ownership of any content you submit to the App, including food images, personal data, meal logs, AI Coach conversations, health data, and other information ("User Content").

License Grant

By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Process and analyze your User Content to provide the service
• Store your User Content on our servers
• Use anonymized and aggregated data for service improvement and research
• Display your User Content back to you within the App
• Process your conversations with the AI Coach to generate responses
• Analyze your meal patterns to provide personalized recommendations

Health Data

For diabetes and other health-related data:

• Health data will be stored securely with encryption
• We will not share identifiable health data with third parties except as required by law or with your explicit consent
• Anonymized health data may be used for research only with your opt-in consent
• You can delete all health data at any time through app settings

Content Guidelines

You agree that your User Content will not:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Contain harmful, offensive, or inappropriate material
• Include personal information of others without consent
• Be used to impersonate others or misrepresent your identity
• Be used to provide medical advice to others

Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

8. Prohibited Uses

You agree not to use the App for any unlawful purpose or in any way that could damage, disable, or impair the App. Specifically, you shall not:

• Attempt to gain unauthorized access to any part of the App or its related systems
• Use any automated system or software to extract data from the App
• Reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality or servers
• Bypass any security measures or access controls
• Introduce viruses, malware, or other malicious code
• Attempt to manipulate or exploit the AI Coach system

Usage Restrictions

• Use the App for any illegal or unauthorized purpose
• Violate any applicable local, state, national, or international law
• Impersonate any person or entity or misrepresent your affiliation
• Harass, abuse, or harm another person through the App
• Collect or store personal data about other users
• Use the App to distribute spam or unsolicited messages
• Resell or commercially exploit the App or its content
• Use the App to provide medical advice or services to others
• Use the App in any way that could create liability for us
• Share AI-generated insulin recommendations with others

9. Limitation of Liability

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of information, including nutritional data, insulin calculations, and AI-generated advice
• Uninterrupted or error-free service
• Medical accuracy or suitability for diabetes management

Limitation of Damages

AFRIVANCE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data or information
• Loss of business opportunities
• Personal injury or health issues, including complications from diabetes management
• Hypoglycemia, hyperglycemia, diabetic ketoacidosis, or other medical emergencies
• Reliance on nutritional information, insulin calculations, or AI-generated recommendations
• Errors or inaccuracies in AI-generated estimates, meal plans, or health guidance
• Failure to seek timely medical care due to reliance on the App
• Adverse reactions to foods suggested by the App

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App in the past 12 months (currently $0 for the free version).

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App or our website.

Notification of Changes

We will notify you of material changes through:

• In-app notifications
• Email notifications (if you've provided an email address)
• Prominent notice on our website
• Update to the "Last Updated" date at the top of these Terms

Health Feature Changes

Material changes affecting diabetes management or other health features will require explicit opt-in consent before you can continue using those features.

Acceptance of Changes

Your continued use of the App after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App and may delete your account.

11. Termination

Termination by You

You may terminate your account at any time by:

• Deleting your account through the App settings
• Uninstalling the App from your device

Note: Account deletion will permanently remove all your data, including meal history, AI Coach conversations, and diabetes management data within 30 days.

Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws
• Fraudulent, abusive, or illegal activity
• Misuse of diabetes or health features
• Requests from law enforcement or government authorities
• Discontinuation of the App
• Technical or security issues
• Extended periods of inactivity

Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• Your account and data may be deleted
• You must cease all use of the App
• Provisions that by their nature should survive will remain in effect
• You remain responsible for ensuring continuity of your healthcare

Trademarks

"Macros AI," "Afrivance AI," and related logos are trademarks of Afrivance AI. You may not use these trademarks without our prior written permission.

Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Distribute, transfer, or sublicense the App
• Remove or alter any proprietary notices
• Use our trademarks or branding without permission
• Claim ownership of AI-generated content

The App uses third-party services including:

• Google Cloud Services: For data storage and authentication
• Google Gemini AI: For food image analysis, AI Coach conversations, and meal plan generation
• Firebase: For backend services and real-time data synchronization
• Expo: For app development and camera functionality
• Firebase Analytics: For app performance monitoring

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or data practices of third-party service providers.

AI Processing: When you use the AI Coach, your messages and data are processed by Google Gemini AI according to Google's terms and privacy policies.

• Your use of the App, including use of diabetes management features
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Any harmful or illegal actions you take
• Health decisions made based on App information
• Insulin or medication adjustments based on App recommendations
• Failure to seek appropriate medical care

16. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Informal Resolution

If you have any dispute with us, you agree to first contact us at info@afrivance.ai to attempt to resolve the dispute informally for at least 30 days.

Arbitration

If we cannot resolve the dispute informally, any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of arbitration in Kenya.

Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class action or collective action.

Medical Disputes

Nothing in this section prevents you from seeking immediate medical care or reporting health concerns to appropriate authorities.

Additional Legal Information

• Assignment: We may assign our rights and obligations under these Terms. You may not assign these Terms without our prior written consent.
